Terms of use
This Game License and Service Agreement (hereinafter referred to as "this Agreement") is entered into by you and the game service provider and has contractual effect. Please carefully read and fully understand all the terms, especially the clauses that exempt or limit liability (hereinafter referred to as "Disclaimer Clauses"), clauses that restrict user rights (hereinafter referred to as "Restriction Clauses"), clauses that stipulate dispute resolution methods and jurisdiction, and separate agreements for activating or using a particular service. The aforementioned disclaimer, limitation, dispute resolution, and jurisdiction clauses may be highlighted in bold, color-coded, or other reasonable ways to draw your attention, including but not limited to Articles 2, 3, 4, 6, and 9 of this Agreement. Please read the aforementioned clauses again before confirming your agreement to this Agreement or before using the game service. Please read all the terms of this Agreement carefully. If you agree to this Agreement, you may continue to use the game service. If you have any comments or suggestions regarding this Agreement or the game service, please contact customer service. Clicking "Agree," "Accept," or "Next," or registering or using the game service, constitutes your acceptance of and agreement to this Agreement. I. **Definitions** 1.1 **This Agreement:** Refers to the main text of this Agreement, the Game Rules, and their revised versions. Once officially published, the above content becomes an integral part of this Agreement. 1.2 **Game Rules:** Refers to the user guidelines, player regulations, game announcements, prompts, and notices regarding the game, which the game service provider publishes and revises from time to time. 1.3 **Game:** Refers to all games operated by the provider, including computer client games, web games, HTML5 games (H5 games), mobile games, TV games, and other forms of games; games may be provided in software form, in which case the game also includes the related software and related documentation. 1.4 **Game Services:** Refers to the various online operational services related to the game that you provide. 1.5 **You:** Also known as a "player" or "user," refers to a natural person authorized to use the game and its services. 1.6 **Game Data:** Refers to various data generated by you during your use of the game and recorded by the server, including but not limited to character data, virtual item data, behavior logs, purchase logs, etc. 1.7 Game Virtual Items: These are services provided and stored electromagnetically on the server where the game program runs. They enable specific functions set by the game program or reflect specific results of the game program's operation. They can be represented in text, graphics, or other digital forms. Game virtual items are part of the game service. Common game virtual items include, but are not limited to: (1) Game tokens and other game currencies. Game tokens refer to virtual items purchased directly or indirectly by users using legal tender at a certain ratio, stored on the specific game server, and can only be used to exchange for other virtual items and other value-added services specified in that specific game; (2) Game equipment, such as weapons; (3) Heroes, skins, and other various game virtual items. II. [Game Services] 2.1 Subject to your compliance with this Agreement and relevant laws and regulations, you are granted a personal, non-transferable, and non-exclusive license to use the Game Services. You may only use the Game Services for non-commercial purposes, including: (1) Receiving, downloading, installing, launching, upgrading, logging in, displaying, running, and/or taking screenshots of the game; (2) Creating game characters, setting usernames, viewing game rules, user profiles, game results, opening game rooms, setting game parameters, purchasing and using virtual game items, and using chat and social sharing functions; (3) Using one or more other functions supported and permitted by the game. 2.2 During your use of the Game Services, you may not record, stream, or disseminate game content to others in any way without permission, including but not limited to using any third-party software for online streaming or dissemination. 2.3 If the game is provided in software form, your use of the game and the Game Services shall also comply with the provisions of Article 5 of this Agreement regarding software licensing. 2.4 All other rights not expressly granted in this clause and other provisions of this Agreement are reserved, and you must obtain separate written permission to exercise such rights. 2.5 If you breach any provision of this Agreement, you have the right to take one or more of the measures stipulated in Article 6.5, Paragraph 2 of this Agreement, and may publish the results of such actions, and/or have the right to claim compensation from you for all losses caused by your breach. 2.6 You fully understand and agree that you have the right to take reasonable action against any behavior that violates relevant laws and regulations or the provisions of this Agreement, to take appropriate legal action against any user who violates laws and regulations, and to preserve relevant information and report it to relevant departments in accordance with laws and regulations. Users shall bear all legal liabilities arising therefrom. 2.7 You fully understand and agree that you shall be solely responsible for any claims, demands, or losses asserted by third parties arising from or caused by your breach of this Agreement or related service terms; you shall also compensate for any losses suffered as a result. 2.8 You fully understand and agree that virtual game items and other value-added game services are part of the game service, and you are hereby granted the right to use them under this Agreement. Your purchase and use of game virtual items and other game value-added services shall comply with the requirements of this agreement and the specific rules of the game. Furthermore, game virtual items and other game value-added services may be subject to a certain validity period. Even if you do not use them within the specified validity period, they will automatically expire upon the expiration date, except for force majeure or reasons attributable to you. If the relevant game virtual items and other game value-added services do not specify a usage period, or if the specified usage period is "permanent" or other content with the same or similar meaning as "permanent" (such as "unlimited," "unrestricted," etc.), then the usage period shall be from the date you obtain the game virtual item or other game value-added service until the date the game ceases operation. You fully understand and agree that, in order to better provide users with game services, the company has the right to adjust, update, or optimize game-related content (including but not limited to the design, performance, and related numerical settings of game virtual items). 2.9 You fully understand and agree that, to protect the security of your game account and to create a fair, healthy, and safe gaming environment, during your use of the game services, without violating relevant laws and regulations, technical means may be used to access the random access memory of your terminal device and related programs running concurrently with the game. Any unauthorized programs that endanger the normal operation of the game services will be dealt with reasonably. 2.10 Providing game services to users is a commercial activity. Users have the right to independently decide whether to pay the corresponding fees according to their determined charging items (including but not limited to the right to use virtual game items and other value-added services) and charging standards to obtain the corresponding game services. If you do not pay the corresponding fees according to the standards, you will not be able to obtain the corresponding game services. You acknowledge and agree that changes or adjustments to charging items or charging standards are normal commercial activities, and you shall not demand compensation or reimbursement due to changes or adjustments to charging items or charging standards. You acknowledge and agree that when you use legal tender to recharge your game account to purchase or redeem virtual game items and other value-added services, these items and services are non-refundable and non-redeemable in legal tender, unless otherwise mandated by law. You acknowledge and agree that if your transaction for purchasing or redeeming virtual game items and other value-added services is cancelled due to refunds or other reasons, the company has the right to deduct the corresponding virtual game items and value-added services from your game account. If the virtual game items and value-added services in your game account are insufficient to cover the deduction, the shortfall may be deducted first when additional virtual game items and value-added services are added to your game account subsequently. 2.11 Under no circumstances shall the company be liable for losses suffered by you during your use of the game services due to force majeure. Such force majeure events include, but are not limited to, national laws, regulations, policies, orders from national authorities and other governmental actions, or other unpredictable, unavoidable, and insurmountable events such as earthquakes, floods, snowstorms, fires, tsunamis, typhoons, strikes, and wars. 2.12 Your game account data, including virtual items, or game data may become abnormal due to game software bugs, version update defects, third-party virus attacks, or any other factors. Before the cause of the data anomaly is determined, we reserve the right to temporarily freeze the game account. If the data anomaly is found to be caused by abnormal game behavior, we reserve the right to restore the game account data to its original state before the anomaly occurred (including recovering transferred data from third parties) without incurring any liability to you. If the data anomaly is caused by your illegal or irregular behavior or violation of this agreement, we reserve the right to take one or more of the measures stipulated in Article 6.5, Paragraph 2 of this agreement. You understand and agree that if the game is deployed on multiple servers, during game operation, in order to improve the game's playability and interactivity and create a better gaming environment, the number of servers may be adjusted in a timely manner based on factors such as the number of active users on the game servers. Users from multiple servers may be temporarily or permanently merged or migrated to the same server (i.e., "server merging" or "region merging"). If the game involves server or region merging, you will be notified via in-game announcements or other means beforehand, and specific rules regarding the merge will be published. Server or region merging may cause changes to game settings, user experience, and user-related game data such as leaderboards, but will not adjust the functionality of your virtual in-game items. Please refer to the official game rules for details regarding server or region merging. If server or region merging results in duplicate character names, team names (if any), and other related content, the game developers may randomly assign new names to distinguish between them. 2.13 Without permission, you may not trade game virtual items or other value-added services with other users, or obtain game virtual items or other value-added services from third parties through purchase, gift, or other means. We are not responsible for third-party transactions (third-party transactions refer to your obtaining game virtual items or other value-added services from third parties through purchase, gift, or other means), and will not handle any complaints arising from disputes related to third-party transactions. 2.14 You fully understand that there is an objective incompatibility between different operating systems. This objective incompatibility is not caused by any reason, and may result in your recharge and game data not being successfully transferred from one operating system to another. You shall bear the risk of recharge losses and game data loss caused by switching between different systems, and we shall not be liable for any such losses. 2.15 You fully understand that the game may have mandatory battle areas or gameplay modes. If you do not agree to mandatory battles, please do not enter the game or game area; your entry will be considered as acceptance of this gameplay mode and the corresponding consequences. 2.16 When the game operator decides to terminate its operation, or if the game terminates its operation for any other reason, it will handle matters related to the termination of game operation in accordance with the relevant national laws and regulations concerning the termination of online game operation, in order to protect the legitimate rights and interests of users. III. [User Behavior Guidelines] 3.1 You fully understand and agree that you are responsible for all actions under your game account, including any content you publish and any consequences arising therefrom. 3.2 Except for using the game services as stipulated in this agreement, you shall not engage in any behavior that infringes upon the intellectual property rights of the game, or any other behavior that harms the legitimate rights and interests of any other third party. 3.3 When using the game or game services, you must abide by laws and regulations and must not use the game or game services to engage in illegal or irregular activities, including but not limited to the following: (i) Violating the basic principles established by the Constitution; (ii) Endangering national unity, sovereignty, and territorial integrity; (iii) Disclosing state secrets, endangering national security, or damaging national honor and interests; (iv) Inciting ethnic hatred or discrimination, undermining ethnic unity, or infringing upon ethnic customs and habits; (v) Promoting cults or superstitions; (vi) Spreading rumors, disrupting social order, or undermining social stability; (vii) Promoting obscenity, pornography, gambling, violence, or instigating crime; (viii) Insulting or defaming others, or infringing upon the legitimate rights and interests of others; (ix) Violating social morality; (x) Other content prohibited by laws, administrative regulations, and national provisions. 3.4 Unless permitted by law or with written permission, you may not engage in the following activities: (1) Deleting copyright information from the game software and its copies; (2) Reverse engineering, disassembling, decompiling, or otherwise attempting to discover the source code or other confidential content of the game software, including but not limited to game elements not yet publicly disclosed but already contained in the game installation package; (3) Scanning, probing, and testing the game software to detect, discover, and find potential bugs or weaknesses; (4) Copying, modifying, adding, deleting, attaching, or creating any derivative works of the game software or data released into any terminal memory during software operation, client-server interaction data during software operation, and system data necessary for software operation, including but not limited to using plug-ins, add-ons, or unauthorized third-party tools/services to access the software and related systems; (5) Modifying or forging instructions or data during software operation, adding... Adding, deleting, or altering the functions or operating effects of the software, or operating or disseminating software or methods used for the above purposes to the public, regardless of whether such actions are for commercial purposes; (6) Using the game and game services through unauthorized third-party software, plug-ins, add-ons, or systems, or creating, publishing, or disseminating unauthorized third-party software, plug-ins, add-ons, or systems; (7) Using, renting, lending, copying, modifying, linking, reprinting, compiling, publishing, or establishing mirror sites for content in the game that possesses intellectual property rights; (8) Establishing mirror sites related to the game, or taking webpage (network) snapshots, or providing others with services that are exactly the same or similar to the game services by setting up servers; (9) Separating any part of the game for separate use, or engaging in other uses that do not comply with this agreement; (10) Using, modifying, or covering the name, trademarks, or other intellectual property rights of the game; (11) Other acts without express authorization. 3.5 If you engage in any of the following behaviors (hereinafter also referred to as "illegal or irregular behaviors") during your use of the game service, we have the right to take one or more of the measures stipulated in Section 2 of this Article, depending on the severity of the circumstances, in accordance with the provisions of this Agreement and relevant game rules, and may announce the results of such actions: (1) Using or uploading illegal or inappropriate words, characters, and other content in the game, including for character naming; (2) Disrupting the game or affecting the normal operation of the game service in any way, including but not limited to: 1) Violating regulations and/or maliciously registering or logging into the game, including but not limited to maliciously registering game accounts in bulk, and logging into the game by disrupting server authentication or maliciously causing server overload; 2) Maliciously engaging in behaviors that may cause the game server to crash or lag, or cause other game players to disconnect or experience delays, making it impossible to play normally, such as using DDoS attacks to conduct network traffic attacks on the game server or other players; 3) Exploiting game vulnerabilities to gain benefits, disrupt the game environment, or cause adverse effects on other players; 4) Playing the game passively and disrupting the gaming experience of other users. This includes, but is not limited to, maliciously harming or killing teammates, maliciously forming teams, maliciously feeding or lowering scores, passively AFKing, running away, intentionally feeding kills, and other negative gameplay behaviors that disrupt the user's gaming experience; 5) Other behaviors that result in abnormal game data performance and affect the fairness of the game. (3) Using various private servers or cheats; (4) Using game synchronizers (specifically including but not limited to using hardware synchronizers such as keyboards and mice to simultaneously control multiple computers for gaming with one set of keyboard and mouse), and using other hardware that can cause abnormal performance in game efficiency or revenue data (including but not limited to "auto-clickers," hereinafter collectively referred to as "cheating hardware"); (5) Spreading illegal remarks or inappropriate information; (6) Stealing other people's game accounts or game items; (7) Engaging in game account trading, account sharing, or other behaviors that affect account security; (8) Without permission, engaging in unauthorized trading of game virtual items and other game value-added services with other users, or obtaining them from third parties through purchase, acceptance of gifts, or other means. (9) Recharging the game through unauthorized or unapproved discount channels, trading discounted game items (e.g., purchasing discounted skins at low prices through unofficial channels), entrusting unauthorized or unapproved third parties to recharge on behalf of the user, or using unauthorized or unapproved third-party software to recharge; (10) In any way, implying or falsely claiming to be an internal employee or having a special status in an attempt to obtain improper benefits or affect the rights and interests of other users; (11) Violating any provision of this agreement or any provision of national laws and regulations; (12) Other misconduct widely recognized in the industry, or other violations announced through game rules (including but not limited to user guidelines, player regulations, game announcements, prompts, and notices). The measures stipulated in the preceding paragraph include, but are not limited to: (1) Warning; and/or (2) Mute, including but not limited to game-wide mute, single-region mute, and public channel mute; and/or (3) Content reset, including but not limited to resetting or forcibly modifying illegal information or content such as illegal nicknames, room names, and pictures that you have provided or uploaded; and/or (4) Reduction or restriction of your game benefits, including but not limited to the improvement of all data related to the growth and leveling up of your game character (such as experience points, honor points, reputation points, titles, etc.) and the acquisition of virtual items and other value-added services in the game; and/or (5) Deletion or cancellation of game account, game data, or other game-related information; and/or (6) Restriction or prohibition of your entry into specific scenes in the game or use of specific game functions; and/or (7) Forced exit from the game (i.e., "kick out of the game"), including but not limited to forced exit from the entire game, or a single game match in the game, or other game activities that you are currently engaging in; And/or (8) Temporarily or permanently ban your game account from logging into the game (hereinafter referred to as "account ban"); and/or (9) Temporarily or permanently ban you from logging into the game on specific terminals (including but not limited to PC terminals, mobile terminals, etc.) involved in your illegal or irregular behavior; and/or (10) Suspend or terminate your use of the game and related services, or unilaterally notify you of the termination of this agreement; and/or (11) File a corresponding civil lawsuit for your illegal or irregular behavior, pursue your infringement, breach of contract or other civil liability, and require you to compensate the company for the losses suffered by the company due to your illegal or irregular behavior (including the company's direct economic losses, reputation or goodwill losses, and compensation, settlement fees, attorney fees, litigation costs and other indirect losses paid by the company to external parties), or transfer the case to the relevant administrative authorities for administrative penalties, or transfer the case to the judicial authorities to pursue your criminal liability; and/or (12) Other handling measures announced through the game rules (including but not limited to user guidelines, player regulations, game announcements, prompts and notices). You acknowledge and agree that, due to the concealed nature or disappearance of cheating hardware such as plug-ins and game synchronizers after use, the company has the right to determine whether you have used illegal plug-ins or game synchronizers based on your game data and abnormal behavior. 3.6 You acknowledge and agree that, if your game account is banned in accordance with this agreement, the specific ban period will be determined based on the severity of your violation. You acknowledge and agree that: (1) During the ban period, game virtual items and other value-added services in your game account will be unavailable; (2) If the aforementioned game virtual items and other value-added services have a certain validity period, this validity period may expire during the ban period. After your game account is unbanned, you will not be able to use such expired game virtual items and other value-added services. IV. [Intellectual Property] 4.1 Is the intellectual property rights holder of the game. All copyrights, trademarks, patents, trade secrets, and other intellectual property rights and other legitimate rights of the game (including but not limited to the game as a whole, all art, music, text works, and other game elements and components contained within the game, as well as the continuous dynamic visuals presented during game operation), and all information content related to the game (including text, images, audio, video, charts, interface design, layout framework, related data, or electronic documents, etc.) are protected by the laws and regulations of the People's Republic of China and relevant international treaties, and enjoy the aforementioned intellectual property rights and legitimate rights, except for the rights that the relevant rights holders should enjoy according to law. Without prior written consent, you may not commercially use the game (including but not limited to the game as a whole, all art, music, text works, and other game elements and components contained within the game, as well as the continuous dynamic visuals presented during game operation) or disseminate the game content through information networks in any way. 4.2 If the game has a platform function or service that allows you to create, produce, or upload relevant content (hereinafter referred to as the "UGC Platform"), you shall ensure that the content you create, produce, upload, or publish using the UGC Platform (hereinafter referred to as "UGC Content") is legal and does not infringe upon the legitimate rights and interests of others, and shall comply with the relevant rules published on the UGC Platform (hereinafter referred to as the "UGC Platform Rules"), and you agree that: (1) If the UGC Content contains game content (including but not limited to the game as a whole, all art, music, literary works and other game components and elements contained in the game, and continuous dynamic images presented during game operation) and/or other content for which the company owns intellectual property rights, then your use of the UGC Content for commercial purposes requires the company's written authorization and consent, and you shall comply with the corresponding UGC Platform Rules. (2) Regarding UGC content, you irrevocably authorize the use of UGC content in any way (the aforementioned "use" includes, but is not limited to, copying, distribution, rental, exhibition, performance, broadcasting, modification, adaptation, dissemination via information networks, and other uses, including both commercial and non-commercial uses, uses within and outside the game, and uses both within and outside the UGC platform. For ease of description, the aforementioned rights of use are collectively referred to as the "Right of Use"), and authorize the sublicense or sub-licensing of the aforementioned Right of Use to third parties. You warrant that such use will not infringe upon any third party's intellectual property rights or other legitimate rights. (3) Regarding UGC content, you may only display or use the UGC content in accordance with the approved methods on the game and other approved platforms. You may not disseminate it on other platforms without permission or authorize any third party to do so, nor may you publish, commercially profit from, create derivative works, or use it in any other way without permission or authorize any third party to do so. Any violation will be subject to legal action. (4) Regarding UGC content, you irrevocably authorize, in your own name or by entrusting a professional third party, to protect your legitimate rights and interests in relation to infringements of UGC content. Such protection includes, but is not limited to, monitoring infringing acts, sending legal letters, initiating litigation or arbitration, mediation, and settlement. You have the right to make decisions and implement these protection measures independently. (5) If, according to copyright law and other relevant laws, you possess moral rights such as the right of publication, the right of attribution, the right of modification, and the right to protect the integrity of the work in relation to UGC content, you agree to decide whether and how to attribute your name based on the specific usage or scenario of the UGC. You will not assert any moral rights such as the right of publication, the right of attribution, the right of modification, or the right to protect the integrity of the work by using UGC content as stipulated in this agreement. 4.3 Ownership and intellectual property rights of the game data generated during your use of the game service belong to the owner. You have the right to store and dispose of such game data, unless otherwise stipulated by national laws and regulations. You enjoy the property rights stipulated by laws and regulations for the related data products and services formed by the legal processing of game data. 4.4 The game may involve third-party intellectual property rights. If such third parties have any requirements regarding your use of such intellectual property rights in the game based on this agreement, they will inform you of such requirements in an appropriate manner, and you shall comply with them. V. [Compliance with Local Laws and Regulations] 5.1 You shall comply with relevant local laws and regulations and respect local morals and customs while using the game services. If your actions violate local laws, regulations, or morals, you shall bear sole responsibility for it. 5.2 You should avoid becoming involved in political or public events due to your use of the game services; otherwise, the service to you shall be suspended or terminated. VI. [Other] 6.1 We reserve the right to modify the terms of this Agreement when necessary. You can view the latest version of the agreement terms on the relevant page of the game. If you continue to use the game service after the terms of this Agreement are modified, it will be deemed that you have accepted the modified agreement. 6.2 We remind you: Resist harmful games and reject pirated games; pay attention to self-protection and beware of being deceived; moderate gaming is beneficial to the brain, while excessive gaming is harmful to health; arrange your time reasonably and enjoy a healthy life.
